§ 1 - Provider, Inclusion of Terms and Conditions *
(1) The provider and contracting party for the goods presented in the Worawo Shop is Worawo OHG, Dankwartstraße 13, 23966 Wismar, Telephone 03841281528, Email info@worawo.de (hereinafter referred to as "Provider").
(2) These general terms and conditions are an integral part of every contractual agreement between the provider and the respective customer. Any conflicting terms and conditions of the customer are hereby objected to.
-
§ 2 - Product Offering and Contract Conclusion *
(1) The provider offers the items displayed in its Worawo Shop for purchase by other Worawo users. The color representation of the items on the website may slightly vary depending on the customer's internet browser and monitor settings; these deviations are technically unavoidable.
(2) Product selection, contract conclusion, and contract processing take place in the German language.
(3) The provider delivers exclusively to customers with a delivery address within Germany.
(4) The customer selects the desired goods by adding them to the "shopping cart." In the "Review and order" step, the customer receives a summary for error-checking. The order can be submitted to the provider by clicking the "Place Order" button. Until the submission of the order, the customer has the option to correct the entries at any time by navigating back one or more steps in the browser or canceling the order altogether.
(5) The provider makes a binding offer to purchase the goods displayed in the shop. By sending the order via the "Place Order" button, the customer accepts the purchase offer. The provider confirms the conclusion of the contract by email (order confirmation).
(6) The content of a completed contract (contract text) is automatically stored by Worawo in the Worawo user accounts of the provider and the customer and can be viewed by the customer in their user account on the Worawo portal under the menu "My Worawo" and the section "My Purchases." After the conclusion of the contract, the customer also receives an email from Worawo with the contract text. The provider does not store the contract text itself and does not make it accessible outside of Worawo.
(7) In case of delivery obstacles or other circumstances that would impede the fulfillment of the contract, the provider informs the customer by email.
-
§ 3 - Prices and Payment *
(1) All product prices are total prices plus shipping costs. The fees include the statutory value-added tax.
(2) Shipping costs are specified in the respective product description under the section "Payment & Shipping."
(3) The provider delivers, at the customer's choice, against prepayment by redeeming a Worawo voucher, against prepayment by bank transfer, or against prepayment via PayPal. Upon order confirmation, the customer receives an email with an internet link leading to the Worawo area "My Purchases," which contains further information on the purchase process.
(a) For payment using a Worawo voucher, the customer can enter one or more voucher codes in the "My Purchases" area. The voucher value is credited to the provider, settling the invoice amount in this manner. If the voucher value exceeds the invoice amount, the voucher remains valid for the surplus amount.
(b) If the customer has chosen "Bank Transfer" as the payment method, the provider provides the customer with the bank details in the "My Purchases" area. The provider only accepts foreign transfers as fee-free payments in euros.
(c) If the customer has chosen "PayPal" as the payment method, they will be directed to the online service of PayPal via the "My Purchases" area and can arrange the payment there.
(4) If additional payment methods are listed in the product description under the section "Payment and Shipping" (e.g., credit card, instant transfer, iDEAL, EPS), such payments are processed through the payment service provider Mangopay (Mangopay S.A., 59 Boulevard Royal, 2449 Luxembourg, www.mangopay.com).
(5) For prepayment orders, a payment deadline of one week from the receipt of the order confirmation applies. The provider reserves the desired goods for the customer during the payment period. It is the customer's responsibility to make the payment in a timely manner so that it reaches the provider within the deadline. The provider reserves the right to withdraw from the purchase contract and sell the goods elsewhere if the payment is not received by the end of the deadline. Any payments received from the customer after withdrawal will be refunded to the customer.
-
§ 4 - Shipping, Delivery Times *
(1) The provider delivers the goods within 4-6 working days from the payment date.
(2) For products marked as "customizable" in the product description, the delivery time is extended by one week if the customer requests such customization.
(3) Multiple products ordered simultaneously will be delivered in a single shipment; the delivery time of the product with the longest delivery time applies to the entire shipment. If the customer wishes to receive a specific product with a shorter delivery time in advance, they must order that product separately.
(4) If the delivery to the customer fails because the customer has provided an incorrect or incomplete delivery address, a new delivery attempt will only be made if the customer assumes the immediate costs of the re-shipping. These costs correspond to the agreed shipping costs at the time of contract conclusion.
(5) The above paragraphs do not apply to digital content (§ 5).
-
§ 5 - Digital Content *
(1) A product offered as digital content is not shipped by postal means. Instead, the customer receives the product or a link to a website where the product can be downloaded (download link) via email.
(2) If the customer expressly agrees to the execution of the contract before the expiration of the withdrawal period and confirms that this results in the waiver of their withdrawal right, the provider delivers the digital content within three working days from the payment date. If the customer declares to be a business buyer, this delivery time applies regardless of such confirmation. In other cases, the provider delivers within three working days from the payment date but not before the expiration of 17 days from the contract conclusion.
(3) For digitally customized content, the delivery time resulting from paragraph 2 is extended by one week.
(4) Receiving digital content requires that the customer has an email address and an internet connection. The provider points out that the customer's email and/or network operator may charge fees for data reception, over which the provider has no control.
-
§ 6 - Consumer Right of Withdrawal *
(1) A customer who purchases as a consumer has a right of withdrawal according to statutory conditions. A consumer is any natural person who concludes a legal transaction for purposes that predominantly cannot be attributed to their commercial or self-employed professional activity.
(2) A consumer with a permanent residence outside of Germany is granted a consumer right of withdrawal according to German conditions and legal consequences, even if the national law of the consumer does not provide for a right of withdrawal or ties the withdrawal to a shorter period or a stricter form than under German law.
-
§ 7 - Warranty (Defective Goods) *
The customer is entitled to warranty claims (also called defect liability rights) in accordance with statutory provisions.
-
§ 8 - Final Provisions *
(1) German law applies, excluding the UN Convention on Contracts for the International Sale of Goods, for residents of Germany. However, German law does not apply to consumers with a permanent residence abroad if the national law of the consumer contains provisions from which deviations to the detriment of the consumer cannot be made by contract.
(2) If the customer is a merchant, a legal entity under public law, or a public-law special fund, the parties agree on the provider's place of business as the exclusive place of jurisdiction.
(3) Should individual provisions of these general terms and conditions be or become invalid or unenforceable, this shall not affect the validity of the remaining provisions.
